The Act was passed in 1995 to protect property owners from lawmakers passing laws that hurt small landlords and discouraged the creation of new housing. Berkeley City Council has enacted Ordinance No. 7568.

This prohibits landlords from discriminating based on source of income. If approached by a Section 8 tenant please be aware that saying "no" could be considered housing discrimination. Please contact an attorney before rejecting a tenant application due to their source of income or being a Section 8 tenant.
